Ecommerce and the Internet
Trade and business over the internet (so called “e-commerce”) has increased significantly over the last fifteen years.
The European Union has introduced common EU wide legislation to validate contracts over the internet so as to facilitate e-commerce. There are several sets of EU wide rules which are of importance in the context of e-commerce.
Data Protection legislation was first introduced over 20 years ago to protect individuals whose personal information is held in electronic or other similar forms. Data Protection rules are especially important in internet marketing and commerce.
In addition to Data Protection legislation, there are specific restrictions and obligations that apply to direct marketing. Direct marketing can be electronic or can be through more traditional means such as fax, phone calling etc. There are restrictions designed to prevent SPAM and cold calling of consumers.
The EU has provided specific protections for customers who buy products by means of distance communication such as the internet, mail order, t.v. sales, e-mail, fax etc. Businesses must to comply with these rules and procedures in business conducted through distance communication.
More generally, computers and IT technology raise issues for businesses in terms of internet policy and the website content. Information technology and service contracts has become a significant purchase so that attention should be given to IT supplier issues.
