Lavelle Coleman's commercial litigation practice has earned the firm a considerable reputation in all aspects of Commercial Law. In particular, Lavelle Coleman has developed a strong profile in the Commercial High Court, having acted in up to 10% of the cases heard in this Court.
We recognise the commercial realities for our clients and believe in taking a commercial approach to dispute resolution. We recognise that litigation may not always be a satisfactory option for clients and we have considerable experience in the areas of mediation and arbitration. When litigation is necessary to protect a client's interest or advance their commercial requirements, we are pro-active and fully resource a case to achieve the best outcome. We give dedicated attention to a particular case, including on an urgent basis, where injunctive proceedings may be necessary.
We represent clients in all Court jurisdictions nationwide, as well as in alternative dispute resolution fora such as mediation and arbitration. Two of our commercial partners, Marc Fitzgibbon and Brian Baily, are CEDR accredited mediators.
We recently acted for a property developer in a high profile Commercial Court case against ACC Bank plc. The High Court awarded the developer €4.8 million in damages for losses suffered as a result of ACC Bank plc losing the title deeds to certain properties. This landmark decision has created new case law in respect of a mortgagors duty of care to an equitable mortgagee.
